Survey Instructions
MyCarePlanner is a patient-facing application under development. It is a product of the Multiple Chronic Conditions (MCC) electronic care (e-)Care Plan Initiative, which is a joint project between AHRQ and the National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK). Funded by the Assistant Secretary for Planning and Evaluation (ASPE) and the Department of Health and Human Services’ Patient-Centered Outcomes Research Trust Fund (PCOR-TF), the MCC e-Care Plan project aims to build capacity for pragmatic, patient-centered outcomes research by developing an interoperable electronic care plan to facilitate aggregation and sharing of critical patient-centered health data across various settings for people living with multiple chronic conditions. MYCAREPLANNER USER AGREEMENT
RTI International (“RTI”) and Oregon Health & Science University (“OHSU”) (collectively “we,” “us,” or “our”) with funding from the National institutes of Health (“NIH”) and Agency for Healthcare Research and Quality (“AHRQ”) are developing an application called “MyCarePlanner.”
This User Agreement (the “Agreement”) set forth the terms and conditions upon which we, the above mentioned entities via a web-based version of the MyCarePlanner application hosted by OHSU on an OHSU server, offer you ( "you" "your" or "End-User"). By accessing the web-based version of MyCarePlanner hosted by OHSU on an OHSU server (the "Service"), or otherwise indicating your assent, you agree to be bound by this Agreement. Additionally, by accessing the Service, you agree to be bound by the Privacy Policy specific to MyCarePlanner, OHSU’s Notice of Privacy, and all applicable laws. In the event of an inconsistency between this Agreement and the Privacy Policy, the terms of this Agreement shall control. Any reference to the singular in this Agreement includes the plural and vice versa and reference to a gender includes all other genders unless the context requires otherwise. Any reference to a "person" in these this Agreement includes any individual, firm, unincorporated association, or body corporate. IF YOU DO NOT AGREE TO THIS AGREEMENT, DO NOT ACCESS OR USE THE SERVICE, APP OR WEBSITE. THIS IS A LEGALLY ENFORCEABLE CONTRACT.
1. DESCRIPTION OF SERVICE
The Service is a medical record (or protected health information, “PHI”) retrieval and management service that allows users of the Service ("Users") to consolidate certain protected health information ("PHI") through the Service. Users may also share information through the Service with others (including family members and caregivers to whom you have given proxy access, doctors, and other healthcare providers). The Service is provided to you through an application under development called MyCarePlanner as an aid to assist you in organizing and managing your medical records.
2. YOUR USE OF THE SERVICE
The web-based version of MyCarePlanner hosted by OHSU on an OHSU server may review the information that you maintain through the Service to normalize and label data for display, but OHSU is not responsible for any errors in the information resulting from such review process. OHSU makes no effort to review the information for any other purpose, including, but not limited to, accuracy, legality or non-infringement. OHSU is not responsible for any information provided by external providers or their patient portal sites. OHSU cannot guarantee nor assume responsibility for the completeness, timeliness, accuracy, relevance, deletion, nor non-delivery of any information via the the web-based version of MyCarePlanner.
Your right to access and use the Service is personal to you, and is not transferable by you to any other person or entity. You are only entitled to access and use the Service for lawful purposes. Accurate information enables OHSU to provide the Service to you. You must provide true, accurate, current, and complete information, and may not misrepresent information (a) in your PHI or (b) about your family members, caregivers, or external providers. In order for the Service to function effectively, you must also keep information listed above up-to-date and accurate. If you do not do this, the accuracy and effectiveness of the Service will be affected.
Your access and use of the Service may be interrupted from time to time for any of several reasons, including, without limitation, unanticipated system failures, the malfunction of equipment, periodic updating, maintenance or repair of the the web-based version of MyCarePlanner or other actions beyond the control of OHSU that OHSU, in its sole discretion, may elect to take. OHSU cannot always foresee or anticipate technical or other difficulties which may result in, and OHSU shall therefore not be responsible or liable for, any (a) failure to obtain PHI, (b) loss of PHI or personalization settings, or (c) other service interruptions.
3. WARRANTIES AND LIMITATIONS OF LIABILITY.
3.1 Warranties.
OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application warrant that they will use commercially reasonable efforts to cause the Service to operate in as intended. The sole obligation of OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application, and End-User’s sole remedy with respect to any failure of the Service to substantially conform to the documentation therefore, is for OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application to use commercially reasonable efforts to remedy any such failure as soon as is reasonably practicable, and if such failure is not remedied in a reasonable time, for End-User to terminate its access to the Service pursuant to Section 6.2.
3.2 No Specific Results.
Specifically, OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application do not represent, warrant or otherwise guarantee: (a) the reliability and suitability of the Service; (b) the effectiveness, suitability or reliability of communicated information (including any data provided through the Service); (c) that the Service will work without interruption or that it will be free of errors, viruses or other harmful components; (d) outcomes resulting from your use of the Service; (e) that the information available on the Service is comprehensive or exhaustive, or that it addresses all relevant symptoms, medicines, and treatments for various diseases or medical conditions; or (f) any outcome with respect to health and well-being as a result of the application of this information.
3.3 No Practice of Medicine.
The Service is not intended to be, and must not be taken to be, the practice of medicine or other healthcare services. Use of the Service does not create a physician/patient or provider/patient relationship with OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application are not recommending or endorsing any specific treatment, physician, healthcare provider or medication.
3.4 Data Collection; Privacy Policy.
Any personal data (for example, your name, address, telephone number or e-mail address) that you transmit to the Service will be used by OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application in accordance with the Privacy Policy.
3.5 Ability to Contract; Legal Age.
The Service is offered and available to users who are 18 years of age or older. By using the Service , you represent and warrant that you are of legal age to form a binding contract with OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application and meet all of the foregoing eligibility requirements. If you are under the age of 18, make sure that your parent or legal guardian reads and agrees with this Agreement on your behalf, as your parent or legal guardian shall be fully responsible for your compliance with this Agreement. If you do not meet all of these requirements, you must not access or use the Website, Service or the App.
3.6 Warranty Disclaimer.
EXCEPT AS SET FORTH IN SECTION 4.1, YOU UNDERSTAND AND AGREE THAT THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND THAT OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application DISCLAIM ANY AND ALL WARRANTIES RELATING TO THE SERVICE OR ANY OTHER MATTER COVERED BY THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, WILL OPERATE WITHOUT INTERRUPTION OR DELAY AND/OR BE ERROR-FREE, OR THAT ALL FAILURES OF THE SERVICE TO CONFORM TO THE DOCUMENTATION PROVIDED CAN OR WILL BE CORRECTED. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application MAKE NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY OF ANY CONTENT PROCESSED BY THE SERVICE. MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN CHOOSING AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
3.7 Limitations of Liability
IN NO EVENT SHALL OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application, OR OUR DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE FOR LOST PROFITS OR BUSINESS, LOSS OF GOODWILL, LOSS OF DATA, INTERRUPTION OF BUSINESS, OR FOR ANY EXEMPLARY, PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, REGARDLESS OF WHETHER SUCH DAMAGES ARISE UNDER ANY THEORY OF TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE AND REGARDLESS OF WHETHER SUCH PARTY IS ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. The aggregate liability of OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application for any and all claims arising under or in connection with this Agreement or its subject matter shall not exceed $500. The above limitation, or exclusion, may not apply to you to the extent that applicable law prohibits the limitation or exclusion of liability for incidental or consequential damages.
3.8 Essential Part of the Bargain.
The parties acknowledge that the disclaimers and limitations set forth in this Section 4 are an essential element of this Agreement between the parties and the parties would not have entered into this Agreement without such disclaimers and limitations.
3.9 Telecommunication Services.
Use of the Service may be available through a compatible mobile device, Internet, and/or network access and may require software. You agree that you are solely responsible for these requirements, including any applicable changes, updates and fees as well as the terms of your agreement with your mobile device and telecommunications providers. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application MAKE NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS, STATUTORY OR IMPLIED AS TO: (a) THE AVAILABILITY OF TELECOMMUNICATION SERVICES FROM YOUR PROVIDER AND ACCESS TO THE SERVICE AT ANY TIME OR FROM ANY LOCATION; (b) ANY LOSS, DAMAGE, OR OTHER SECURITY INTRUSION OF THE TELECOMMUNICATION SERVICES; AND (c) ANY DISCLOSURE OF INFORMATION TO THIRD PARTIES OR FAILURE TO TRANSMIT ANY DATA, COMMUNICATIONS OR SETTINGS CONNECTED WITH THE SERVICE.
4. INDEMNIFICATION; UNAUTHORIZED USE
4.1 Indemnification.
End-User hereby agrees to indemnify and hold harmless OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application, our officers, employees, agents, subsidiaries, affiliates, licensors, suppliers and other partners from any and all damages, costs and expenses (including, without limitation, reasonable attorneys' fees) suffered or incurred by OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application in connection with any claims that all said entities are required to pay to third parties to the extent such damages, settlement amounts, costs and expenses are attributable to End-User's (a) use of the Service, or (b) provision of content by the End-User Content through the Service ("End-User Content"), including any actual or alleged volitions of third party intellectual property by such End-User Content.
4.2 Notification of Unauthorized Use.
End-User shall promptly notify OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application in writing upon its discovery of any unauthorized use or infringement of the Service, related documentation, or intellectual property rights with respect thereto. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application shall have the sole and exclusive right to bring an infringement action or proceeding against any infringing third party and, in the event that said entities bring such an action or proceeding, End-User shall cooperate and provide full information and assistance to said entities and their counsel in connection with any such action or proceeding.
5. TERM AND TERMINATION
5.1 Term.
End-User’s access to the Service shall begin on the date End-User signs into the web-based version of the MyCarePlanner application for the first time, and shall continue until the end of the research study or a written request by End-User to discontinue participation in the research study, whichever comes first.
5.2 Termination for Convenience.
OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application may terminate End-User’s access to all or part of the Service at any time with or without notifying you. End-User may terminate access to the Service at any time by notifying the research team, in writing, that End-User wishes to discontinue participation in the research study. Upon termination of research participation, data will be deleted in accordance with the privacy policy section titled “Use & Sharing of Personal Information”.
5.3 Effect of Termination.
Upon the termination of the Service, all license rights of End-User under this Agreement regarding the Service shall automatically and immediately cease and End-User shall promptly cease all uses of the Service.
6. GENERAL
6.1 Export Compliance.
The Service may be subject to U.S. and other national export controls and economic sanctions. The rights and obligations of End-User shall be subject to such United States laws and regulations as shall from time to time govern the license and delivery of technology abroad by persons subject to the jurisdiction of the United States, including the Export Administration Act of 1979, as amended, any successor legislation to the Export Administration Act of 1979, and the Export Administration regulations issued by the Department of Commerce, International Trade Administration, Office of Export Administration. End-User shall certify that it shall not, directly or indirectly, export, re-export or transship the Service in such manner as to violate such laws and regulations in effect from time to time. End-User shall indemnify and hold harmless OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application from and against any and all losses, claims and expenses incurred by OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application as a result of the breach of End-User's obligations under this Section.
6.2 Governing Law.
This Agreement is governed by the laws of the State of Oregon, without regard to its choice of law provisions. The courts of general jurisdiction located within Portland, Oregon, will have exclusive jurisdiction over any and all disputes arising out of, relating to or concerning this Agreement or in which this Agreement are a material fact. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application make no representation that materials contained in the Service are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. If you choose to access the Service from other locations you do so by your own choice, and are responsible for obeying local laws.
6.3 Waiver of Jury Trial and Class Actions.
BY ENTERING INTO THIS AGREEMENT, YOU AND OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application ACKNOWLEDGE AND AGREE TO WAIVE CERTAIN RIGHTS TO LITIGATE DISPUTES IN COURT, TO RECEIVE A JURY TRIAL OR TO PARTICIPATE AS A PLAINTIFF OR AS A CLASS MEMBER IN ANY CLAIM ON A CLASS OR CONSOLIDATED BASIS OR IN A REPRESENTATIVE CAPACITY. YOU AND OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application ALL AGREE THAT ANY ARBITRATION WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT A CONSOLIDATED, CLASS-WIDE OR REPRESENTATIVE BASIS AND THE ARBITRATOR SHALL HAVE NO AUTHORITY TO PROCEED WITH AN ARBITRATION ON A CLASS OR REPRESENTATIVE BASIS. THE ARBITRATOR MAY AWARD INJUNCTIVE RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF WARRANTED BY THAT PARTY’S INDIVIDUAL CLAIM. IF FOR ANY REASON THE ARBITRATION CLAUSE SET FORTH IN THIS AGREEMENT IS DEEMED INAPPLICABLE OR INVALID, OR TO THE EXTENT THE ARBITRATION CLAUSE ALLOWS FOR LITIGATION OF DISPUTES IN COURT, YOU AND OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application ALL WAIVE, TO THE FULLEST EXTENT ALLOWED BY LAW, ANY RIGHT TO PURSUE OR TO PARTICIPATE AS A PLAINTIFF OR AS A CLASS MEMBER IN ANY CLAIM ON A CLASS OR CONSOLIDATED BASIS OR IN A REPRESENTATIVE CAPACITY.
6.4 Third-Party Sites.
The Service may contain links to external websites. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application are not responsible for the content, accuracy or opinions expressed on those external websites, and those external websites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked external website on or through the Service does not imply approval or endorsement of the linked external website by OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application. If you decide to leave the Service and access these external websites, you do so at your own risk.
6.5 Public Statements.
Any party may disclose the existence of this Agreement but may not represent to any third party any positions, statements, intentions or other actions on behalf of the other.
6.6 Assignment.
End-User may not assign any of its rights or privileges, or delegate any of its duties or obligations hereunder to any third party without the prior written consent of OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application. Any purported assignment in contravention of this Section shall be null and void. Subject to the foregoing, this Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective permitted successors and assigns.
6.7 Notices.
All notices and other communications hereunder shall be in writing and shall be deemed effective when delivered by hand, facsimile transmission, reputable overnight delivery service, or certified mail (return receipt requested), postage prepaid to: (a) in the case of End-User, to the address set forth in its account information, and (b) in the case of MyCarePlanner: Oregon Health Sciences University – Care Management Plus 3181 S.W. 6.8 Entire Agreement; Amendment.
This Agreement, including the Privacy Policy specific to the web-based version of MyCarePlanner and OHSU’s Notice of Privacy, constitute the entire agreement between the parties concerning the subject matter hereof and supersedes all prior understandings and agreements between the parties, whether written or oral, regarding the subject matter hereof. OHSU and the other entities mentioned above that are involved in the development of the MyCarePlanner application may modify this Agreement. Any use of the Service following any such modification constitutes an acceptance of the modification. If you do not accept any modification, you must immediately cease all usage of the Service.
6.9 Waivers.
A waiver by any party of a breach or violation of any provision of this Agreement will not constitute or be construed as a waiver of any subsequent breach or violation of that provision or as a waiver of any breach or violation of any other provision of this Agreement.
6.10 Severability.
If any provision of this Agreement is held to be unenforceable, it shall be severed and the remaining provisions will remain enforceable. The severed provision will be replaced by an enforceable provision most nearly reflecting the intention of the parties.
6.11 Admissibility.
A printed version of this Agreement shall be admissible in judicial or administrative proceedings based upon or relating to use of our website to the same extent and subject to the same conditions as other business documents and records originally made and kept in printed form.
6.12 Third-Party Beneficiaries.
Nothing in this Agreement shall be deemed to give any third-party rights or benefits.

Who Are We?

What Are We Doing?
MyCarePlanner is a web portal (“app”), which allows you to access your medical records (also known as protected health information or “PHI”) in one single location. It will also allow you to provide access to your medical records to other individuals such as personal caregivers to whom you have given proxy access. The web portal is based at OHSU, and is currently only being used for research purposes to evaluate the functionality and usefulness of a future application.
We are committed to maintaining the privacy and security of your medical records, and we appreciate that medical information is sensitive. This Privacy Policy describes how OHSU may collect and use your PHI, when you use the MyCarePlanner application to access your medical records (collectively, the "Services"). This Privacy Policy does not address PHI that you provide to OHSU in other contexts (for example, through a business or medical relationship unrelated to the Services).
OHSU’s receipt and use of your PHI may also be subject to OHSU’s Notice of Privacy: https://www.ohsu.edu/information-technology/ohsu-notice-privacy-practices.
By using our Services, you say to us that you agree to the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Services. Your continued use of the Services after we make changes to this Privacy Policy will mean that you agree to those changes.

What Do We Collect from You?
We collect your name, email address, phone number, and mailing address, as part of the research process which you should have already consented to.
In addition, we collect and keep your medical information through the personal health record and sync your medical record information from your healthcare provider(s) or another third-party source. Details on this data storage can be found in the “Use & Sharing of PHI” section below.

We collect your contact information and personal health information when you use the MyCarePlanner application.
From time to time we may request other PHI to provide you with other benefits of the Services. In those instances, you will be given the opportunity to provide or not provide that information, and it will be used only for that purpose.
Automatically Collected Information & Anonymous Information
Web Server Logs and IP Addresses
An Internet Protocol ("IP") address is a number that automatically identifies the computer/machine you have used to access the Internet. Your IP address will be captured when you access MyCarePlanner, but we do not use IP addresses to conduct website analyses or performance reviews.
Aggregated Data
We also collect deidentified logs of various system operations to report errors and to generate usage and performance metrics for analysis. As part of these processes, we may merge information about you into aggregated group data. This data does not include any identifiable personal health information. The anonymous group data may be shared in research products, such as manuscripts or reports; if it is shared, we will not disclose your individual identity.
Use & Sharing of PHI
We only use the PHI you provide, or to which you grant access, for lawful purposes and to provide the service.

- To help prevent, investigate, and resolve security or safety concerns and issues

You Control How Your Medical Information Is Shared
If you have officially designated that another person shall have proxy access to your health care records, then that person will be able to access your data in MyCarePlanner.
Otherwise, your medical records will only be viewable by the OHSU-based research study team for quality improvement purposes. Other staff may occasionally access this data for technical or administrative support. No identifiable data is shared with third-parties. No data is ever sold and will never be used for targeted advertising.
Your medical records will only be stored for the duration of the pilot, with an expected end date of July 31st, 2024. Upon project completion, all medical records will be deleted from the research database.
Portal Information and Portal Credentials
In order to fully benefit from our Services, you may wish to access your medical records from other healthcare providers' organizations ("External Portal Information"). This requires that you enter your third-party health login credentials ("Login Credentials") to those organizations.
We will not retain any of your login credentials, internal to OHSU nor external.
Deleting Your Information
You may also request deletion of your medical records from our research database. Deletion will occur within 45 days of the request. When you choose to delete your medical records, you will no longer be eligible to participate in the pilot research study, so your participation will be discontinued. The only information that will not be deleted is information that has already been used to inform the course of the pilot study, and the log information that we keep for audit and legal purposes.

Security
We understand that transporting and storing your PHI in a secure manner is important. We store your PHI and other data using industry standard physical, technical and administrative safeguards to secure data against foreseeable risks, such as unauthorized use, access, disclosure, destruction or modification. In the unlikely event of a data breach, we will make every effort to notify all users.

We understand the importance of protecting children's privacy in the interactive online world. Our website is not designed for, or intentionally targeted at, children under 13 years of age. What is MyCarePlanner?
MyCarePlanner is an application that is being developed with the goal of improving care coordination for people with multiple chronic conditions (MCC). It works in tandem with another application, eCarePlanner, intended to be used by your clinicians. Together, this pair of applications will make patient-centered data available across care and research settings.
Who is funding the development of these applications?
The National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK) is funding the development process itself, and the Agency for Healthcare Research and Quality (AHRQ) is funding the usability testing and evaluation process.
Do I have to pay to use MyCarePlanner?
No. MyCarePlanner and eCarePlanner (the clinician-facing application) are completely open source and available to anyone who thinks they can benefit from their use.
Can I use MyCarePlanner if I receive care in more than one place, from more than one clinician?
MyCarePlanner and eCarePlanner (the clinician-facing application) are being specially designed to coordinate care across multiple settings, locations, and clinicians. The idea is to finally have all your medical records in one convenient place…at your fingertips!

How do I register for the application?
Since the application is currently under development, it is only available for use by participants in our ongoing research study.
To be eligible for research participation you must be:
- 18 years of age or older
- Diagnosed with multiple chronic conditions
- Fluent in English
- A patient at OHSU
